1. Your privacy agreement with Energyspeedometer.com
The EnergySpeedometer Service's (ESO Service) Privacy Policy is part of the terms of use of the ESO Service and thus part of the User Agreement between you (the USER) as an ESO Service user and Baseline Energy.
ESO-APP is the app available on Appstore and Google play.
ESO device is hardware that displays information about your power consumption
2. The purpose of processing your personal data
Baseline Energy processes your personal data in accordance with the Personal Data Act to which Baseline Energy is subject by the Norwegian Data Protection Authority.
The Personal Data Act consists of national rules and the EU General Data Protection Regulation (also known as GDPR)
The purpose of Baseline Energy's processing of personal data in connection with your use of the ESO service is primarily to fulfill the obligations Baseline Energy has undertaken to implement the User Agreement. In the ESO service, personal data is also processed for the following purposes, among others:
- Provide you with information about your power consumption, forecasts of future power consumption and other features
- Customer follow-up and marketing
- To provide relevant information and advertising
- Further development and improvement of the ESO service
- Statistics and consumption analysis
3. Assets in ESO-APP
ESO-APP needs different accesses to your mobile phone for different functionalities in ESO-APP to work. These accesses are:
- Storage: Data used by the ESO-APP system is stored in the device and on servers
- Mobile data: - to enable you to use ESO-APP when you are not connected to a wireless network.
Other accesses will require special permission from the USER when using the service.
- Camera: Video, photos - so you can capture and upload video and photos.
- Change/delete content in SD card (Android) - to enable you to upload photos.
- Microphone: In connection with videos that can be uploaded on ESO-APP.
- Contacts: To help you find people in your contact list to invite family and friends, among other things.
- SMS: Used in connection with sending invitations to people and other customer information.
- Notifications in the app: Used to inform about current customer information, e.g. offers, news.
- Location: If you have provided access to location information, this information is used to tailor services to you and others. For example, if you are close to a location where you can take advantage of a customer benefit.
4. What information does the ESO service store
The ESO Service stores information that you provide in ESO-APP when you register, customer information in Baseline Energy's customer information system, and the data generated when you use the service.
The ESO service processes and stores the following data to the extent they are made available:
- The data that you make available in ESO-APP.
- Your phone number and email address
- Which mobile device you use and your device's operating system
- Name, address, date of birth, national identity number
- Demographic data
- Email and other contact information about family, friends,
- Meter number, electricity consumption from electricity meter and other information related to energy consumption including, if applicable, electric car charging, usage pattern energy use, etc.
- Information about the home and housing-related information to, among other things, prepare forecasts
- Information about the production of electricity from solar cells and other sources.
- Personal preferences with a focus on power, energy consumption, environment, and topics that fall into the same category.
- Other data that is important for creating good customer relationships.
4.1. Advertising
If conditions are met for advertising to be displayed in the ESO device and ESO-APP, data may also be processed, compiled and stored to provide you with the most relevant information and advertising. This may be information about searches made on Google search engine or similar used to target advertising to you.
5. Disclosure of personal data
Information that can be linked to you as a person will not be shared with others unless it follows from this User Agreement, is authorized by law or that you have specifically consented to it.
Baseline Energy may share your personal data with subcontractors who process the personal data on Baseline Energy's behalf (data processors). Transfer of personal data to such data processors takes place in accordance with data processing agreements that, among other things, prevent the data processor from using the data for other purposes. Transfer of personal data to Baseline Energy's data processors is not considered disclosure.
Baseline Energy may disclose personal data to other companies that Baseline Energy cooperates with.
6. Customer follow-up and marketing
Data that is available may be used and compiled to enable Baseline Energy to inform you about products and services that Baseline Energy believes are relevant to you. Baseline Energy may also provide you with information about other products using electronic marketing, if you have consented to this.
Baseline Energy may send you information and offers about products and services by means of electronic communications to your mobile phone number, to your provided email address, push messages and social media. Consent under this provision includes electronic marketing of all types of products and services, not just products you have previously consented to. You can withdraw your consent at any time by going to Settings, Consent in ESO-APP.
If the conditions for advertising are fulfilled cf. User Agreement, consent cannot be withdrawn without terminating the use of the ESO service.
7. Access, correction and deletion
You can gain access to the information Baseline Energy has registered about you by sending a written and signed request to Baseline Energy. Baseline Energy will contact you to correct any information about you that turns out to be incorrect. Personal data will not be stored for longer than is necessary to fulfill the purpose of the processing. After this, the information will be deleted or anonymized, unless the information must or can be stored beyond this as a result of law. This also applies if you delete your ESO-APP profile. Information about your transactions will be stored by Baseline Energy for as long as required by law.
8. Security of personal data
Personal data collected by Baseline Energy is stored and processed in a safe and secure manner. Baseline Energy has established and documented routines and measures to ensure the integrity, availability and confidentiality of the data.
9. Changes
Baseline Energy may change this Privacy Policy to comply with legal requirements, as well as Baseline Energy's own data collection and processing practices. In case of major changes, you will have to re-accept the terms and conditions.
10. Data controller
Baseline Energy is the data controller for the processing of personal data set out in this privacy statement. If you have any questions about the ESO service's privacy policy, please contact Baseline Energy at servicedesk@baseline.energy.
11. Right to complain to the Data Inspectorate
It is possible to lodge a complaint with the Norwegian Data Protection Authority if you believe that the data controller is not complying with legal requirements.
